Terms of Service
Effective date: 18 December 2025
By using Fective AI’s websites, applications, APIs, and any related services (the “Service”), you agree to these Terms of Service (the “Terms”) and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.
1. Changes to these Terms
We may update these Terms from time to time. The effective date above will reflect the latest version. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
2. Eligibility and authority
You must be at least 18 years old to use the Service. The Service is designed primarily for business and professional use, but individual users are not excluded. If you use the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. You agree that all information you provide is accurate and kept up to date.
3. Accounts, credentials, and security
You are responsible for maintaining the confidentiality of your login credentials and API keys and for all activity that occurs under your account. You must notify us immediately of any suspected unauthorized access or security incident by contacting martin@fective.ai.
4. License and acceptable use
Subject to these Terms, Fective AI grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for your internal business purposes.
You may not:
violate any applicable law or third‑party rights;
bypass, disable, or interfere with security features, rate limits, or access controls, or scrape or bulk‑download content beyond documented limits;
reverse engineer, decompile, disassemble, or attempt to extract source code, models, or model weights;
use the Service or its outputs to train or build a substantially similar or competing product;
upload malware or otherwise disrupt or degrade the Service;
use the Service for market manipulation, insider trading, or other unlawful or unethical activities.
Additional requirements may be set out in our Acceptable Use Policy (AUP), which forms part of these Terms.
5. Subscriptions and billing
Pricing, plans, and features are described in‑app or at checkout. Subscriptions renew automatically until canceled. You may cancel at any time; access will continue until the end of the current billing period. Fees are non‑refundable except where required by law or expressly stated in our billing terms. Taxes may apply. Payments are processed by third‑party payment providers.
6. Data, privacy, and processing
You retain ownership of all content, data, or materials you submit to the Service, including descriptions of your products, services, customers, or sales activities ("User Content"). You grant Fective AI a worldwide, non-exclusive license to host, process, analyze, and display User Content solely to operate, secure, and improve the Service.
Fective AI operates proprietary data pipelines and sources. Except for User Content you explicitly submit, you acknowledge that Fective AI’s underlying data sources, methodologies, and data collection processes are confidential and form part of Fective AI’s proprietary technology.
We do not train our AI models on User Content or customer-specific outputs. We may generate aggregated or de-identified usage statistics that do not identify you or your customers, which may be used for analytics, benchmarking, and product improvement.
Personal data is handled in accordance with our Privacy Policy and Cookie Policy. Where you are a business customer, our Data Processing Addendum (DPA) applies and forms part of these Terms, with you acting as data controller and Fective AI as data processor.
7. AI‑generated output and no professional advice
The Service uses automated and AI‑based systems to generate summaries, analyses, scores, and other outputs. These outputs may be inaccurate, incomplete, or out of date and should not be relied upon without independent verification.
The Service does not provide investment, legal, tax, or other professional advice. Fective AI is not a broker‑dealer, investment adviser, or fiduciary.
8. Intellectual property
The Service, including all software, models, designs, and documentation, is owned by Fective AI or its licensors and is protected by intellectual property laws. Except for the limited license expressly granted above, no rights are granted to you. You may not remove proprietary notices or create derivative works based on the Service.
9. Service changes and support
We may modify, suspend, or discontinue parts of the Service at any time. Unless expressly agreed otherwise, the Service is provided without any service‑level commitment. Support is provided on a reasonable efforts basis during standard business hours.
10. Termination
We may suspend or terminate your access to the Service if you breach these Terms, fail to pay applicable fees, or pose a security or legal risk. You may stop using the Service and cancel your subscription at any time. Upon termination, your license ends and access to the Service will cease.
Upon written request, we will delete your User Content without undue delay. If no deletion request is made, User Content will be retained for up to sixty (60) days following termination, unless a longer retention period is required by applicable law.
11. Disclaimers and limitation of liability
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Fective AI disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non‑infringement.
To the maximum extent permitted by law, Fective AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities. Fective AI’s total liability under these Terms will not exceed the amounts paid by you to Fective AI in the twelve (12) months preceding the claim, or €100 if no fees were paid.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Dubai International Financial Centre (DIFC). Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the DIFC Courts, Dubai, United Arab Emirates, except where mandatory consumer protection laws apply.
Fective AI is operated by a Meydan Free Zone limited liability company registered in Dubai, United Arab Emirates.
